Double Jeopardy Clause Animation

  1. I do believe that individuals that are tried for a crime should not be tried again for the same crime under double jeopardy. However after thinking about it, what if for example new evidence surfaced that could possibly bring a serial killer to justice and get him off the streets? I believe that there should be an exception for crimes of this kind of magnitude. What do you think? do you think there should be an exception? what do you think the effects oh establishing an exception for crimes like murder would be?

    Its a fantastic question and needs to be given some thought. My initial reaction to the question would be to make an exception in such cases that supersede normal. I have noticed that when serial murders are being prosecuted the prosecutor will often leave one murder on the books so that if anything would go horribly wrong with their attempt to gain a conviction there is that one case as a back up. The family needs to be willing to allow this to happen and would have to be ok with their case not being tried but knowing it was part of a bigger strategy.
